Austin man sentenced to prison time on felony sexual conduct charge in Mower County District Court

An Austin man who was already on supervised probation for a felony charge of distributing via electronic communication material that relates/describes sexual conduct to a child, and for a felony charge of attempted 4th degree criminal sexual conduct with a victim less than 16 years of age has been sentenced to prison time in Mower County District Court for an additional felony charge of distributing or engaging in electronic material relating to sex to a child.

28-year old Brandon James Nisley was convicted and sentenced Thursday to 15 months in prison for a felony charge of distributing via electronic communication material that relates or describes sexual conduct to a child.  The charge stems from an incident on December 12th, 2021 when Nisley sent and/or received a lewd image of a 13-year old girl.  An agent with the Department of Corrections seized a phone from Nisley that contained the lewd image in January, and Nisley first pleaded guilty to the charge on January 12th.

Four additional felony charges for distributing via electronic communication material that relates or describes sexual conduct to a child in the case were dismissed with Nisley’s guilty plea.
