Blooming Prairie man sentenced to prison time in Mower County District Court for felony drug possession and sale charges

A Blooming Prairie man facing several different charges in Mower County District Court, including for drug possession, drug sale and DWI stemming from a traffic stop on June 6th, 2019, and from an incident in February of 2020 has been sentenced to prison time.

39-year old Michael Phillip Chavez was convicted and sentenced Thursday to 13 months in prison for a felony 5th degree drug possession charge.  Chavez was also convicted and sentenced to 180 days in jail for a gross misdemeanor charge of DWI, operating a motor vehicle with the body containing any amount of Schedule I or II drugs, not marijuana.  Chavez was given credit for 123 days already served, and he first pleaded guilty to the two charges on November 24th, 2021.  In another case stemming from an incident that took place on February 5th, 2020, Chavez was convicted and sentenced to 67 months in prison for a felony charge of 2nd degree drugs, sale of 10 grams or more of a narcotic other than heroin within a 90-day period.  Chavez pleaded guilty to the charge on March 18th, and a felony 5th degree drug possession charge, plus a petty misdemeanor charge for possession of drug paraphernalia in that case were dismissed with Chavez’s guilty plea.  

An additional felony 5th degree drug possession charge against Chavez for the June 2019 incident, plus a gross misdemeanor charge for 3rd degree DWI, under the influence of a controlled substance, misdemeanor charges for possession of over 1.4 grams of marijuana in a motor vehicle and driving after suspension, plus a petty misdemeanor charge for possession of drug paraphernalia in the case against Chavez were all dismissed with his guilty pleas.
