Sioux Falls, South Dakota man pleads guilty to felony 2nd degree murder charge in Mower County District Court

A Sioux Falls, South Dakota man who was facing three felony murder charges stemming from the shooting death of an Austin man at his residence in June of 2021 has pleaded guilty to one of them in Mower County District Court.  

19-year old Miguel Nunez Jr. had been charged with a felony for 2nd degree murder, with intent, not premeditated and two counts of felony 2nd degree murder, without intent, while committing a felony in the June 5, 2021, death of 45-year old David Harris.  Authorities reported that Nunez shot Harris multiple times in the chest during an attempted drug robbery at his residence in the 100 block of 12th St. NE in Austin.  Nunez was arrested at a residence in Sioux Falls on July 15th, 2021.  

A trial for Nunez in Mower County District Court was to have started on July 11th, but Nunez pleaded guilty Wednesday to one of the felony charges of 2nd degree murder, without intent, while committing a felony.  Nunez had originally pleaded not guilty to all of the charges against him in on August 12th, 2021 

Sentencing for Nunez in Mower County District Court has been scheduled for October 27th.  Nunez is being held in the Mower County jail, with bail with conditions set at $500,000, and $1 million without conditions.
