Austin man sentenced to supervised probation, jail time on drug possession, domestic assault charges in Mower County District Court

An Austin man who was found with approximately 1.09 grams of methamphetamine and two methamphetamine pipes in his vehicle after a search warrant was executed on it in a school zone in the 200 block of 12th Street Northwest in Austin on September 18th, 2020 has been sentenced to supervised probation in Mower County District Court.

54-year old Thomas Irvin Percival was convicted and sentenced Thursday to two years of supervised probation for a felony 5th degree drug possession charge.  Percival was granted a stay of adjudication in the case where the defendant pleads guilty to a felony level offense. A conviction for a felony is not entered on the defendant’s criminal record, provided he or she successfully completes their probation. Once the defendant successfully completes probation, the charges are dismissed, and their criminal record is cleared of any convictions.  Percival first pleaded guilty to the charge in August of 2021, and a felony charge for 3rd degree drugs, possession of methamphetamine in a school zone, a gross misdemeanor charge for user of a controlled substance in possession of a firearm and a petty misdemeanor charge for possession of drug paraphernalia in the case were all dismissed with Percival’s guilty plea.

Percival was also sentenced Thursday to 24 days in jail for a misdemeanor charge of domestic assault, commits act to cause fear of immediate bodily harm or death for an incident that took place on September 7th, 2020.  Percival was given credit for 27 days already served, and he was convicted on the charge on August 23rd, 2021 after pleading guilty the same day. Felony charges for 1st degree burglary, assault a person in a building on property, 1st degree burglary of an occupied dwelling and for terroristic threats in the case were dismissed with Percival’s guilty plea.
